1.Subject matter and scope

The Portal is aimed at the registration of customers/distributors (hereinafter the "Professional") of FLUIDRA, for the management of online purchases that occur through it and for obtaining information about products, activities and / or news of FLUIDRA (hereinafter the "Portal")

Specifically, the Portal allows the Professional:

• ● Manage their account in the Portal;
• ● Allow the management of online purchases;
• ● Allow the visualization of the catalog and prices of FLUIDRA's products;
• ● Preservation and management of the final client portfolio of each Professional;
• ● Sending of orders and quotes;
• ● Manage their consultations, questions or requests made through the service channels; and
• ● Tracking the history of customer orders.

This Portal is aimed at the Professional who has requested access and whose data has been validated and given access by the commercial area of the company.

2. Terms & Conditions of Use

These Terms of Use regulate the access and use of the Portal. The access to it implies the acceptance without reservations of these Terms of Use.

The Professional is the only responsible for the use he may give to the Portal, for all content he reproduces in or through the Portal and for any consequence derived from it.

The Professional undertakes to use this Portal, its contents and services in accordance with the Law, these Terms of Use, good customs and public order. In the same way, he/she is obliged not to use the Portal, its contents or the services provided through it for illicit purposes or effects or contrary to the contents of these Terms of Use, harmful to the interests or rights of third parties, or that in any way could damage, disable, make inaccessible or deteriorate the Portal, its contents or its services or prevent a normal enjoyment of it by other users.

Likewise, the Professional expressly undertakes not to destroy, alter, disable or in any other way damage the data, programs or electronic documents that are in the Portal, and not to hinder the access of other users through the massive consumption of the computer resources through which FLUIDRA provides the service, as well as to carry out actions that damage, interrupt or generate errors in said systems or services.

Similarly, it undertakes not to introduce programs, viruses, macros, applets, ActiveX controls or any other logical device or sequence of characters that cause or are likely to cause any type of alteration in the computer systems of FLUIDRA or third parties.

Documents and graphics published on this server could include technical inaccuracies and typographical errors. Changes are periodically added to the information herein.

FLUIDRA and/or its respective suppliers may make improvements and/or changes in the program at any time.

FLUIDRA reserves the right to disable or block access to the Portal for the Professional in the event that he/she infringes these Terms of Use, the rights of third parties or applicable legislation.

FLUIDRA is not responsible for any possible security errors that may occur or for any possible damage that may be caused to the client/user's device (hardware and software) and the files or documents stored therein, as a result of the presence of a virus in the client/user's device used to connect to the services and contents of the Portal, a malfunction of the Internet, telephone breakdowns, interference, omissions or disconnections in the Portal's operational functioning caused by causes beyond FLUIDRA's control.

3. License of Use of the Portal

FLUIDRA is the owner and holder of all the rights to the Portal and, in this sense, grants the client/user a free license to use the content and functionalities available in the Portal in accordance with the uses for which it has been designed and, in particular, in accordance with the provisions of this document and/or the applicable law.

The license of use of the Portal is limited to the European territorial area, so although the Professional can access the Portal from outside Europe, its use is only authorized within Europe.

4. Intellectual and Industrial Property

All the Intellectual and Industrial Property rights on the information, data, graphics, designs, software, brands and other contents of the Portal are the property of FLUIDRA and/or its licensors, and therefore their use, reproduction, transmission, transformation, distribution or exploitation in any way by the client/user is prohibited, except as part of the service in which the Portal is integrated and for exclusively private purposes. Failure to comply may result in the exercise of any judicial or extrajudicial actions that may correspond to them in the exercise of their rights.

FLUIDRA prohibits any action that is contrary to current legislation, of the documentation/contents that can be downloaded from the Portal. Specifically, it is not permitted to manipulate or make any other use of the contents, including product catalogs, price catalogs, among others.

This Portal shall be governed by and interpreted in accordance with the legislation. In the event that any disagreements or disputes arose, both parties shall submit to the Courts and Tribunals of Barcelona.
